Web Marketing Association Makes Call for Entries for Annual WebAward Competition
Type: News

The Web Marketing Association announced the call for entries for its 15th annual international WebAward Competition for Web site development at webaward.org.

The WebAwards is a competition that sets benchmarks for 96 industries, including legal websites, based on the seven criteria of a successful web site, according to the group. The deadline for legal websites to enter to be judged is May 27.
"The legal industry is very competitive when it comes to Web development and companies can benefit from the independent evaluation of their online efforts," said William Rice, President of the Web Marketing Association. "Not surprisingly, legal websites are not known for taking risks it's the way their industry is. They score well in terms of ease of use, design and content, but past judges have noted they would like to see more use of technology and innovation."

The group noted web sites are judged on seven criteria including design, innovation, content, technology, interactivity, copy writing and ease of use. Each WebAward entry in the legal category is judged against other legal entries and then against an overall standard of excellence.

All legal entrants benefit from receiving valuable feedback in terms of their specific scores compared against the average scores for their industry. They also may receive specific comments from the WebAward's professional judging panel on their Web site development efforts.

Each year the Web Marketing Association names the Best Legal Website based on the scores submitted by the competition judges. Recent winners of the Best Legal Web site include:

2010 - WilmerHale for WilmerHale Careers

2009 - Thomson-FindLaw for Law Offices of Lisa L. Maki

2008 - The Attorney Store for GETLEGAL.COM

2007 - carbonhouse, inc. for Womble Carlyle Sandridge & Rice

SA: Australian wine to meet new environmental standards

ADELAIDE, Dec 7 AAP - Australia's wine industry hopes all its exports will meet new
environmental standards by 2014.

Wine and grape growers on Monday launched EntWine Australia, a voluntary environmental
assurance scheme.

It requires companies to have their practices certified and independently audited to
measure their carbon footprints and to ensure they meet specific standards.

Winemakers' Federation of Australia chief executive Stephen Strachan said the wine
industry was determination to meet modern expectations on environmental stewardship.

"Those who meet or exceed the standards will be able to carry the nationally endorsed
EntWine Australia logo and will be listed on a publicly accessible online register," he
said.

"By 2014 we aim to have all Australian export wine achieving this standard."

Mr Strachan said feedback from the industry about the scheme had been positive and
there was a growing realisation that setting and meeting higher environmental standards
was an important consideration for consumers.

He said the federation was working through the international alcoholic beverage trade
association to ensure EntWine Australia was recognised internationally.

NSW: Fifth teacher arrested over Knox student abuse allegations

SYDNEY, April 29 AAP - A fifth former teacher from Sydney's prestigious Knox Grammar
School has been arrested over child sex allegations dating back 30 years.

The 66-year-old man was arrested on Wednesday at Port Macquarie, on NSW's mid-north
coast, in relation to the alleged indecent assault of a former student.

"The offences are alleged to have taken place while he was a teacher at the school
in 1976 and 1977," police said in a statement.

The man is expected to be charged later on Wednesday, police said.

Strike Force Arika was launched earlier this year to investigate allegations of sexual
abuse of students at the private boy's school in Wahroonga dating back to the 1970s.

Three other former Knox teachers and one current member of staff have already been
charged with child sex offences.

Damien Piers Vance was granted bail by a NSW court on April 9 after being extradited
from Melbourne to face a charge of sexual assault by inciting an indecent act.

Adrian Nisbett, 59, Barrie Tiffin Stewart, 71, and Craig Treloar, 49, were all charged
with multiple offences in February.

Treloar was teaching Year Six at Knox at the time of his arrest on four charges of
indecency and indecent assault relating to complaints made by two former students.

Earlier this month, Knox headmaster John Weeks issued a statement saying the school
was doing everything possible to support former and current students and staff.

"Our commitment to, and implementation of, child protection laws is absolute and leading
edge, and the school regularly reviews and improves its protocols in this area," he said
at the time.

"The school has also provided access to an external counselling service for any past
or present student, parent or staff member who might require it."

Investigations by Strike Force Arika are continuing and anyone with information that
might assist detectives is urged to contact Crime Stoppers on 1800 333 000.

NSW: Toddler revived after near drowning in spa

SYDNEY, April 10 AAP - A toddler was revived by his parents after nearly drowning in
an indoor spa in Sydney's south-west, emergency workers say.

The 14-month-old boy was only in the spa at the house at Gemas Street, Holsworthy,
for a matter of minutes before he was found not breathing by a family member at about
2.30pm (AEST) today.

The boy's parents started CPR immediately and he started breathing again after about a minute.

Ambulance officers and the NRMA CareFlight flying trauma team were called to the scene
where a doctor and ambulance paramedics combined to stabilise the boy then place him on
a ventilator to control his breathing.

NRMA CareFlight flew the toddler to Westmead Children's Hospital under full intensive
care monitoring.

He was in a critical but improving condition on arrival there at 3.30pm, a CareFlight
spokesman said.

"The fact that family members started resuscitation made all the difference," the spokesman said.

WA: Corruption probe into wrongful murder conviction wraps up

WA: Corruption probe into wrongful murder conviction wraps up

By Andrea Hayward

PERTH, AAP - A retired NSW judge is expected this week to wrap up a four-month inquiry
into a 1994 murder investigation that will decide the future of five senior West Australian
police officers and a leading prosecutor.

Andrew Mallard was convicted in November 1995 of the 1994 murder of Pamela Lawrence
in her Mosman Park jewellery store, in Perth's west.

He spent 12 years in jail before walking free last year when the Director of Public
Prosecutions (DPP) decided not to retry his case.

His conviction was quashed by the High Court in 2005, which declared a miscarriage
of justice had occurred.

Mr Mallard was not released until last year when the DPP said it would not retry Mr
Mallard because it lacked credible evidence to obtain a conviction against him.

An investigation conducted for WA's powerful Corruption and Crime Commission (CCC)
by former NSW Supreme Court judge John Dunford QC has been investigating whether there
was any misconduct by police and prosecutors involved in the murder case.

But Mr Dunford will not deliver his findings until April next year in a case which
has struck at the heart of WA's police force and judiciary.

Two detectives involved in the investigation of Mr Mallard, are now assistant police
commissioners: Mal Shervill and David Caporn.

Superintendent John Brandham, Inspector Alan Carter and Sergeant Mark Emmett, detectives
involved in investigation, have also been scrutinised for their roles at the time.

Officers involved polished statements, planted evidence on Mr Mallard and removed and
changed facts in witness statements, and rewrote their written accounts of interviews,
the inquiry has been told.

An undercover officer codenamed `Gary' gave Mr Mallard, who was suffering from a mental
illness, a cannabis smoking implement and planted jewellery from Ms Lawrence's store on
him, it was told.

Deputy DPP Ken Bates, who was a senior prosecutor at the Mallard trial, has been accused
of incompetence, failing to fairly present the case against Mr Mallard and misleading
the jury.

Supreme Court justice John McKechnie, the DPP in WA at the time Mr Mallard was a suspect,
advised police to charge Mr Mallard on the evidence they presented to him in 1994.

But the inquiry was told he was not briefed properly by investigating police.

With such far-reaching tentacles within the WA police force and the judiciary, WA had
no choice but to look further afield for an acting commissioner and Mr Dunford was appointed.

Since August, he has heard evidence in hearings, some in private, from police, prosecutors,
the undercover officer and his controller, witnesses in the case and others including
forensic scientists.

The inquiry was in the stages of wrapping up this week, with defence lawyers speaking
on behalf of their clients while slamming others involved in the case.

Mr Shervill's lawyer, Ron Davies QC, told Mr Dunford his client, who faces 14 adverse
findings recommended by counsel assisting the CCC Jeremy Gormly SC, was not involved in
a fitup.

In fact, any suggestion the five officers had framed Mr Mallard were ridiculous, Mr
Davies said in his closing submission.

"They left it in the brief, all of it, all the inconvenient bits, dozens and dozens
of them," Mr Davies said.

"Does it sound like a fit up, commissioner?

"The proposition that this fellow is being framed is simply ridiculous. If they couldn't
have done better than that you would find it very surprising."

Mr Davies then accused WA Labor MP John Quigley, a former lawyer, who championed Mr
Mallard's cause, of making a half-baked allegation of conspiracy.

Mr Gormly has recommended adverse findings against Mr Quigley, who threatened to name
`Gary' in the WA parliament in 2002, if he didn't tell the truth about his involvement
in the case.

He didn't do it but he did give the real name of the undercover officer codenamed `Gary'
and his phone number to journalists at the time.

Last week, Mr Quigley revealed the real names of both `Gary' and his controller `M1',
in the parliament, raising the ire of Mr Davies.

Mr Quigley also took the opportunity to criticise Mr Dunford under parliamentary privilege,
calling him a "muddle-headed old man."

The MP's actions were "disgusting" and conspiratory, Mr Davies said.

"What's left now of the matters that arose out of court allegations and all of Quigley's
outbursts is what in my view ... can be readily demonstrated as a half-baked, suspicion
only, proposition of a pernicious conspiracy to pervert the course of justice," Mr Davies
said.

Mr Bates, against whom Mr Dunford will consider 13 adverse findings recommended by
Mr Gormley, was also heavily criticised by Mr Davies.

"Words like inept and incompetent cross your mind," Mr Davies said.

"I think the best concept I can put to you, sir, is that he is like someone steering
a fairly large ship and he's asleep at the wheel."

Mr Davies said it had become apparent that what Mr Bates had done was not only to let
down the office of prosecutor, for which he has apologised, and the administration of
justice, for which he has apologised, but he let the police officers down terribly and
in particular he let Mr Shervill down.

Mr Bates told the hearing in evidence that he had fallen short of his duties amid a
heavy workload and had done the best he could at the time.

"But with the benefit of hindsight, I accept that I have fallen short and that's a
matter of sincere regret on my part," he said.

Andrew Mallard was described by Mr Davies as "a curious creature", who couldn't "lie
straight in bed to save his life".

Mr Mallard was granted an ex-gratia payment of $200,000 from the WA government last
year and is now studying fine arts at a Perth university.

A palm print from the scene of the murder, discovered during a cold case review of
the murder last year was linked to British backpacker Simon Rochford.

Rochford, who was in jail for the murder of his girlfriend killed himself the day after
police told him he was their new prime suspect in the case.

Mr Gormly slammed Mr Caporn for writing off Lloyd Peirce, a witness who reported "a
man with a bag running from the rear lane in an agitated state", fitting Rochford's description.

However, Mr Gormly said it would have been difficult for them to find Rochford because
the only evidence he left was a partial palm print.

But had the murder remained unsolved, the print may have eventually led police to Rochford,
he said.

Mr Dunford is expected to reveal his findings in April next year.

NSW: Suspected cocaine smuggler was concerned about Schapelle

A court has been told a man accused of plotting to smuggle cocaine through baggage
handlers at Sydney Airport .. became concerned about how the publicity surrounding SCHAPELLE
CORBY's arrest would impact the plan.

IAN ROBERT CHALMERS allegedly told another conspirator during a March phone call last
year .. he'd been watching the news about CORBY's case and how it had been traced back
to airport personnel.

The 41 year old has pleaded not guilty to conspiring to import a commercial quantity
of cocaine into Australia in 2005.

Crown Prosecutor DAVID STAEHLI SC has told the NSW District Court .. CHALMERS had
bought the plane tickets for drug courier PHILLIP GORDON TYLER and organised travel for
another co-accused.

Mr STAEHLI says the plan was to import cocaine from Argentina into Australia with the
help of baggage handlers at the airport.

The courier would fly to Sydney from South America before joining a connecting Qantas
flight to another state.

But Mr STAEHLI says the bag containing the drugs would be intercepted by baggage handlers
and wouldn't be placed on the connecting flight.

He says this case followed the successful importation of nearly 10 kilograms of cocaine
through Sydney Airport in October 2004 .. in which Chalmers was not involved.

The case continues.

Fed: Former UN official to give evidence to AWB inquiry

SYDNEY, April 10 AAP - A former United Nations official has been called on to tell
the Cole inquiry what she knew about AWB's illicit payments to Saddam Hussein's regime.

Senior counsel assisting the inquiry John Agius, SC, today said Felicity Johnston,
a former UN Customs chief, had been asked to provide a sworn statement to commissioner
Terence Cole.

The call for her statement comes after Ms Johnston, who was seconded to the UN from
the British Customs Service, broke her silence to the ABC's Four Corners program about
the AWB kickbacks scandal.

She told the program, to be broadcast tonight, that the Australian government failed
six years ago to act on key warnings about AWB paying "shameful" kickbacks to the Iraqis.

Mr Agius said the UN had agreed to release Ms Johnston from her obligations to the
peace-keeping body and allowed her to provide written and oral evidence to the Cole inquiry.

He said the inquiry had also asked the British Customs Service to give Ms Johnston
authority to give evidence.

"We are confident we will have a statement from Ms Johnston shortly," Mr Agius said.

When Ms Johnston hands her statement to the inquiry it will be kept confidential until
she is called to give evidence.

Ms Johnston told Four Corners she passed on complaints by a third party country, now
known to be Canada, to Department of Foreign Affairs (DFAT) officials in early 2000.

Canada had complained to the UN that AWB was making illicit payments to Iraq in the
form of trucking fees.

The Cole inquiry has heard that AWB paid the fees to Jordanian-based transport firm,
Alia, which was part-owned by Saddam's government.

However DFAT officials have told the inquiry Ms Johnston never mentioned trucking fees
when she raised the concerns about AWB.

"It would have been unthinkable for me as a person who comes from an investigative
customs background that I would not ... have mentioned the most salient point of the allegation,"

Ms Johnston said.

"It's something that could not and would not have occurred."

Meanwhile, Mr Cole has delayed making a decision on whether lawyers for two AWB executives
will be allowed to cross-examine Foreign Minister Alexander Downer when he appears at
the inquiry tomorrow.

Deputy Prime Minister and Trade Minister Mark Vaile will be examined by the inquiry's
lawyers later today.

SA: Liberal senators in the dark in IR reforms say unions

ADELAIDE, Aug 9 AAP - Most Liberal senators have little or no idea of the likely impact
the federal government's proposed industrial reforms will have on workers, a senior union
official says.

SA Unions state secretary Janet Giles said some local Liberal senators the union movement
had contacted had refused to discuss the issue while others expressed surprise about what
was intended.

She said Liberal senators seemed unclear about the details and ill informed about the
probable impact.

"What is clear is that Liberal senators have simply been fed a party line and told
not to waver from it," Ms Giles said.

"But when we've sat down with them to discuss the issue in detail, we've discovered
most have little or no idea about the likely impact on working South Australians."

Ms Giles said unions wanted Liberal senators to take on board their concerns, especially
the impact overriding the state industrial system could have on the manufacturing sector
and the state's ability to win wealth creating contracts.

"Our cooperative industrial relations record is one of South Australia's strongest
assets and to foist a less effective system onto this state would be disruptive and hamper
our growth," she said.

WA: Gas blast destroys Perth units

PERTH, April 3 AAP - A massive gas blast has ripped apart a unit block in Perth, shattering
windows of nearby houses and sending two people to hospital.

The condition of the casualties was not immediately known, but the blast at 6.25am
(WST) today all but destroyed the unit block in Raymond Street at suburban Yokine.

The tenants of the 24 units, many of whom were elderly people, were shaken and shocked
by the incident, which was felt by residents at least 500 metres away.

The explosion happened in unit 10, the central flat on the bottom floor of the complex,
which was owned by one person, according to the managing agents of the block.

Emergency authorities said the blast was so strong it ripped apart the building and
shattered windows and blew doors off other buildings within a 50-metre radius.

"It's like a war zone. It's really quite incredible," a spokesman for the Fire and
Emergency Services Authority (FESA) said.

"The central units where the explosion originated from are totally destroyed.

Search and rescue teams had been through the two storey-building where the blast occurred
but had not found any casualties, he said.

Deneise Burke, from real estate agent Darrell Crouch and Associates, said the units
had been fitted with new gas pipes and gas meters less than six months ago.

"We have to wait as long as it takes for a structural report to see if they are to
be condemned," Ms Burke said.

"But in the meantime, we have been working to rehouse all the tenants - that has been
our main priority."

Nearby residents said the blast could be felt at least 500 metres away, and had shattered
windows in houses directly surrounding the units.

Mario Tornatora said residents from several streets away emerged from their houses
wondering what had happened.

"It sounded like a bomb going off. It was huge. It shook the bloody house. I actually
jumped out of bed," Mr Tornatora said.

The brick-and-tile unit block is understood to have been built in the 1970s.

Another resident Tony Holmes said he was among the first on the scene and saw a man
with his head sticking out of the rubble.

"There was one old boy trapped with rubble on top of him and he was just moaning very
softly," Mr Holmes told ABC radio.

"His head was sticking out of the rubble and from where I was you could see a few cuts on him."

Forensic police officers were at the scene trying to determine what had happened.

A police spokesman said officers were working to secure the premises and ensure it
was safe before further investigations could take place.

Netgear launches Wi-Fi range extender.

Netgear, a worldwide provider of advanced networking and storage products, has released an easy to install and affordable universal Wi-Fi range extender.

The WN3000RP eliminates wireless dead spots and boosts the reach of home networks thereby providing uninterrupted multimedia streaming for the home user and SOHO segment.

According to Netgear, the increasing emergence of internet-enabled mobile and entertainment devices like tablets, laptops, smartphones Blu-Ray players, game consoles and internet capable television sets are connecting to Wi-Fi networks from around the house and even outside on decks and patios.

A big driver for this trend is the growing availability of multimedia streaming, which includes movies, TV shows and music. This in turn, has created a greater consumer demand for strong Wi-Fi connectivity.

However, one issue that users have to deal with while connecting from home networks is the presence of Wi-Fi dead spots. Netgear is looking to solve this problem with the roll out of its strategic line of Universal Wi-Fi range extenders, which increases the coverage of home networks by automatically repeating the wireless signal from a Wi-Fi router or gateway.

"The Middle East region is seeing an increased growth in the use of mobile and internet enabled devices as a means to go online and watch videos, movies, play games and listen to music. These devices are often used for high-bandwidth activities and require rock solid Wi-Fi connections and will enable users to fix dead spot issues," said Ahmad Zeidan, channel sales manager, Netgear Middle East.

"Netgear's universal Wi-Fi range extender makes it possible to enjoy a robust wireless connection in remote corners of the house or outdoors, in places that have low or no Wi-Fi signal."

The WN3000RP is a single, compact, self-contained white cube that plugs into any AC outlet. When paired with routers that have a 'Push-N-Connect' button, the only configuration required is pressing the 'Push-N-Connect' button on the router and then on the extender, according to a statement. -- TradeArabia News Service

HealthcareSource Software Helps Hospitals Improve Physician Retention.

(PRWEB) May 23, 2011

Woburn, MA HealthcareSource(R), the leader in talent management software for the healthcare industry, today announced the addition of a significant new capability for physician retention in version 3.0 of HealthcareSource Physician Recruitment Manager(R), its software solution which helps healthcare recruiters and HR departments streamline and automate their processes for physician recruitment and retention.

The new physician retention feature for Physician Recruitment Manager improves how hospitals connect, engage and get feedback from their medical staff, and newly hired doctors in particular. In order to improve their success and retention, new physician hires can be automatically surveyed 30, 60, 90 days after their employment begins. Through these periodic surveysahospital HR managers can identify issues that emerge during the onboarding phase. By seeking physicians' opinions, and learning what difficulties they are facing in their day-to-day work lives, hospitals can then act to address those issues.

Additionally, Physician Recruitment Manager now helps hospitals manage the documents and licenses of all of its physicians. Departmental recruiters/liaisons will be notified when individual doctors' licenses and contracts are set to expire, allowing for a streamlined renewal process.

"According to the Association of American Medical Colleges, the U.S. could face a shortage of as many as 150,000 physicians in the next 15 years. That's why more hospitals are looking for an edge to attract and retain superior physician talent," said Michael DiPietro, VP of Marketing and Product Management. "The new physician retention functionality in HealthcareSource Physician Recruitment Manager delivers two-fold benefits: physicians will have a stronger voice to share how they feel about their jobs, and their hospital employers will have better information to help in retaining quality doctors. Given the negative financial impact that high physician turnover can have on hospitals, investing in physician recruiting solutions that improve retention is strategically smart."

"Physician Recruitment Manager has been a very powerful tool for us. It allows us to organize and manage our recruiting information very quickly and efficiently," said Mike Fitzner, Director of Physician Recruitment at War Memorial Hospital, a short-term acute care hospital accredited to serving the healthcare needs of Michigan's Upper Peninsula. "The addition of the new retention functionality has really made the product complete as retention of providers has become more important with looming physician shortages."

'You were ... soliciting people to die'; Judge gives former nurse 360-day sentence, $18,000 fine in suicide-chat case.(NEWS)

Byline: RANDY FURST; STAFF WRITER

FARIBAULT, MINN. - The suicide victim's loved ones spared few words Wednesday in denouncing a 48-year-old former nurse who sat at a courtroom table, dabbing his eyes and awaiting sentencing for encouraging two people to kill themselves.

William Melchert-Dinkel was called a predator, a monster and a murderer by the relatives of Nadia Kajouji, 18, who jumped into a river in Ottawa, Canada, in 2008. Her body was found six weeks later.

"For months afterward, nightmares haunted me," said her mother, Deborah Chevalier. "I would give everything I have to be able to spend just one more minute with my child again."

Rice County District Judge Thomas Neuville sentenced Melchert-Dinkel to 360 days in jail under a work-release program, fined him $18,000 and ordered him to pay about $30,000 in restitution. Neuville ordered that the jail time include two-day stints each March and July over the next 10 years, to mark the months in which his victims died.

Neuville told him: "The court finds that you were stalking and soliciting people to die. ... You knew it was wrong."

On March 15, Neuville found Melchert-Dinkel guilty, saying the former nurse had "intentionally advised and encouraged" Kajouji and Mark Drybrough, 32, of Coventry, England, to commit suicide.

Mark Kajouji, Nadia's brother, said in a phone interview from Canada that the sentence was too short: "I don't think justice was served," he said.

Outside the courthouse, Chevalier, of Brampton, Ontario, praised Minnesota authorities for their work on the case. As for the sentence, she said, "I'm her mother. Obviously I was disappointed. ... Justice can never be served."

Asked by the judge if Melchert-Dinkel wished to speak, his attorney, Terry Watkins, said his client had Asperger Syndrome, (a disorder with similarities to autism), so Watkins would read his statement. "I feel intensely remorseful," it said.

Neuville said that there were many victims and that he hoped Melchert-Dinkel "soaked up" the comments in the victim impact statements. The judge said the defendant had subjected his wife and children to "humiliation and shame." Melchert-Dinkel's wife, Joyce, clearly shaken, put her head in her hands.

In an interview with Minnesota investigators, Melchert-Dinkel admitted conversing via the Internet with the two victims about suicide methods, including hanging.

He pretended to be a veteran female nurse also planning to kill herself. He never counseled them to reconsider. In chats with Drybrough, he signed his name "Li Dao," and with Kajouji, called himself "Cami." He encouraged her to use a web cam so he could watch. Prosecutors say he chatted online with 10 people about suicide, five of whom killed themselves.

Drybrough hanged himself July 27, 2005. Kajouji, a college student, disappeared between March 6 and March 9, 2008, and was found in Ottawa's Rideau River.

Appeal planned

Melchert-Dinkel could serve about seven months in jail, if he gets time off for good behavior, Watkins said.

Neuville stayed the jail time, pending an appeal of the conviction, which must be filed by June 1. If the state court of appeals affirms the conviction, he must report for jail in seven days. The fine and restitution payments were not stayed.

County attorney Paul Beaumaster said the sentence was "well reasoned and supported by the facts." The judge adopted the recommendation of a community services officer in a presentence investigation.

Beaumaster said the officer ranked the crimes "higher than most other aiding suicide cases that have been sentenced in the last 10 years, which was appropriate given the egregious conduct." With so few assisted suicide convictions in state history, there's no recommended sentencing level in state guidelines.

Because Melchert-Dinkel had no prior criminal history, court rules called for no state prison time and left the jail sentence up to the judge.

Neuville ordered restitution payments of $9,452 to Chevalier, and $20,000 to Nadia's father, Mohamed Kajouji -- half of what they wanted for expenses that included funeral costs. Neuville noted he had to consider that Melchert-Dinkel was not the sole factor in their deaths.

Both victims had contemplated suicide when Melchert-Dinkel met them in Internet suicide chat rooms.

Neuville stayed a total of 6 1/2 years prison time and put Melchert-Dinkel on probation for 30 years, so a violation could land him in prison. Neuville said he could not work with vulnerable adults and cannot use the Internet, except for work as approved by a probation officer.

Watkins said while he believed it was a "fair sentence," he'll appeal the conviction because his client's "discussions" were "protected free speech." He said his client's actions were "morally ... absolutely wrong" but did not alter the suicide victims' decisions.

Beaumaster said the appeals court has already found the assisted suicide statute constitutional, although never in an Internet case. He said he did not believe the First Amendment gave someone the right to solicit people to kill themselves.

Bayt poll shows Egypt most optimistic about economic growth.

CAIRO: Fifty-six percent of Egyptians "definitely expected improvements" when asked whether they expected to see economic progress following the recent changes in the Middle East, representing the highest percentage in the region, according to the latest online poll conducted by the job site Bayt.com.

The poll, titled "Change and Challenge in the Middle East Job Market: How is it Viewed?", showed that 50 percent of respondents were positive about economic prospects, while 15 percent were not.

When asked whether they believed it was a good time to live and work in the Middle East, 42.2 percent said it was "a better time than ever before," while 22.9 percent believed that it was merely "a good time" and 24.9 percent felt it was not a good time

"The results of our most recent poll showed that despite recent changes occurring in different parts of the region, the Middle East is still considered to be a great place to live and work," Amer Zureikat, Vice President of Sales at Bayt.com, said in a press statement.

"The report also indicated several changes that governments should be considering in order to improve their country's employment. In light of the recent turmoil, I believe we will be seeing a lot more of these come to light," he added.

Regarding the responsibility for unemployment in the region, the majority of respondents, more than 47 percent, blamed the government, while 7.3 percent pointed to the private sector, 5.2 percent blamed poor education and 6.3 percent put the responsibility on the shoulders on the unemployed themselves.

However, more than 92 percent of respondents felt, to varying degrees, that the government was responsible for job creation.

When asked how the government could best improve employment opportunities, nearly half of the respondents said they can do so through the following: creating more jobs in the public sector, improving the education sector, fostering a better environment for business, improving labor laws, stopping corruption and developing better transparency and legal guidelines.

In Egypt, a strong emphasis was made by respondents on ending corruption.

More than 86 percent believed it was possible to "dramatically improve employment prospects through better public policies." Respondents also noted than the internet is aiding employment in their countries.

"Very interestingly, the vast majority of the region's respondents [59.3 percent] also felt that there were many highly qualified professionals and few good jobs which could indicate that the region does in fact need to create more employment through more transparent means," said Zureikat.

Generally, respondents around the region were optimistic about the future, career prospects and their country's economy.

The high level of unemployment, economic difficulties and limited freedoms have led to a series of uprisings around the Middle East region as populist movements have been taking place and ousting longstanding autocratic regimes such as in Tunisia and Egypt.

IT security in the recession.(information technology)

What security challenges do organizations face today?

The focus of security is evolving from protecting assets and reducing risk to enabling business productivity and ensuring compliance. The traditional IT-led approach to security is being replaced by a business led focus on information security.

Organisations operating in an internet oriented world has resulted in technologies evolving more quickly to support business and businesses evolving faster through being enabled by IT. Keeping up with the risks that these new business paradigms pose and neutralising them is difficult given the fact that most consumers, employees and partners are very computer literate.

For example, criminals are targeting organizations in a focused way for financial gain. Executives, employees and customers are potentially exposing themselves through social network sites like Facebook where (for example) all of the published personal data can be correlated with password hint questions.

Many recent stories around security breaches illustrate the pressure within organizations to "get the job done' without reflecting carefully on the consequences of this. Often business processes haven't been in place to ensure good management of information or they have not been robustly enforced.

For global giants these challenges are colossal because they have to operate across different geographies and market sectors, all with their own regulatory requirements.

What impact is the credit crisis having on organizations' approach to security?

The downturn in the economy increases pressure on organizations to become leaner, more competitive and more agile. However it's hard to illustrate a compelling business case for traditional IT Security unless it is linked to revenue generation and not just cost cutting and ensuring against security risks. Other business critical projects often get priority because they have a clearer perceived greater rate of return. Organisations must however remain vigilant in their efforts to be secure. Economic pressures are tough but a major security breach is enough to put an organisation out of business for good.

How should organizations respond to these challenges?

Economic pressures are forcing the CISO role to evolve and become focused on securing the technology to enable the business to succeed. This means looking at security as a 'business service'. For example security can improve integration between suppliers and customers, and allow common access to data in a safe environment. Web technology and identity federation have a strong potential to build organisational performance. In fact, new business models can be enabled directly because of these new technologies.

For example, a retail or telecoms organisation may own its customer relationships, but the service is provided by a partner or supplier. Identity federation enables trust and information sharing to be established throughout the supply chain in order for improved and seamless service delivery.

Mergers and acquisitions also expose a strong need to rationalize processes and IT services to get the expected returns. Identity and access is deeply embedded in business process and there are real gains to be made by adopting best practice and the correct technologies.

Organizations will also look to save costs by outsourcing, but this brings with it new security risks. For example the trend toward visualization and off shoring have increased the volumes of data being transferred externally between organisations. This raises the risk of data being lost or misused, or loss of data access control, so must be mitigated against in security plans.

IT security is becoming business security

IT security needs to be viewed in the context of the whole business rather than focused on a specific technology or process. The security team in an organisation should now engage with the business stakeholders and can discuss how the business can leverage security as an asset. Organizations depend critically upon IT to exist and IT security is becoming more about managing business risk than just operational risk.

IT security needs to be viewed within the bigger picture of aligning IT infrastructure. The objective is to unify and simplify the processes and the technology to better meet the needs of the business to increase agility and reduce cost while complying with the increasing regulatory burden.

IT'S NOT EASY BEING A FAN OF BASEBALL.(Sports)

Byline: TOMMY TRUJILLO

There you are, staring at your television set, eyes focused on that stupid line with tiny letters on the bottom of the screen.

It's Headline News, flashing baseball and soccer scores you don't care about. You've been watching so long, you already know when the baseball score you do care about is about to come up.

It's four away, three away, two away, then the network goes to commercial. That would be OK had the score line picked up where it left off, but no. You have to wait through all those other scores again.

And when your score does come up, there's no guarantee it's going to be updated.

There were old days, back when you could watch your team on TV for maybe 150 of its 162-game season. But when Major League Baseball intervened and sold its soul to Fox and ESPN, the number of those games from local broadcasts were seriously dwindled, and the numbers of games that could be broadcast were limited by MLB. Also, Fox and ESPN could decide which games they would exclusively show.

It wasn't bad when it was just a few games a week, but through the years, this exclusivity crap has taken away Saturday, Sunday and Wednesday night games. And teams usually have their days off on Monday and Thursday, when they're traveling, so if you want to watch a game -- for free, albeit you still have to pay for cable -- your days are limited to Tuesday and Friday, and any day a game is scheduled around the national broadcast.

And that's just for Atlanta Braves fans, who are fortunate enough to have a cable system broadcasting games. TCI doesn't offer WGN -- Chicago Cubs and Chicago White Sox -- or WOR -- New York Mets. I can hardly wait to see what Comcast cable is going to offer in its lineup when it -- thank goodness -- takes over for TCI later this spring.

If you're a Pittsburgh Pirates fan, or a Florida Marlins fan, you're done. You'll probably never -- ever -- see your team on television.

It's not like the NFL season, when you can go to your local tavern and watch any game you want. While bars are more than willing to spring for that special NFL broadcast package, I don't know of any bars who will pay for the multibroadcasts of baseball games. You could pay for it yourself, but that's a big hit.

And a story just moved over the wire that Internet broadcasts of baseball games also will cost a fan money. Just two seasons ago, you could go to a team's Web site and link up to a FREE live broadcast. Last year, you had to go to the Major League Baseball site and link up to its broadcast. If your team was on the road, you'd have to listen to the home team's broadcast. This season, you'll have to pay $9.95 for the feeds for the entire season. Through this deal, Major League Baseball is guaranteed $20 million over three years.

It sure makes it tough to be a baseball fan, especially when a network that has paid billions for the rights tells you what game you're going to watch, and when you're going to watch it.

And you thought the players were greedy.

By the way, speaking of baseball, is Albuquerque, which will be without its minor-league baseball franchise beginning this season, still considered to be the Duke City?

Diva with the download factor nets an instant hit.

Byline: SINEAD MCINTYRE

THE debut single of X Factor winner Leona Lewis has become the fastest selling download ever, with more than 200,000 copies bought over the Internet in under 48 hours.

The 21-year-old former receptionist became the first woman to win the ITV singing contest when she beat rival Ray Quinn, securing a [pounds sterling]1million record deal.

She is on track for a Christmas No 1 with her first release, A Moment Like This.

The CD single goes on sale in the shops on Wednesday.

But it was available for downloading on the Internet from midnight on Saturday.

By last night it had become the fastest-selling download ever with more than 200,000 expected to have been sold by this morning.

The single is also expected to be the fastest selling Christmas No 1.

That record currently belongs to That's My Goal by last year's X Factor winner Shayne Ward, which sold 732,000 copies in three days.

However, shops have already preordered 750,000 copies of Miss Lewis's single.

Bookmakers William Hill have stopped taking bets on the track being the Christmas No 1 because it believes it is a 'dead cert'.

A total of 12.6million viewers tuned in on Saturday to watch Miss Lewis became the first black winner of a British reality show.

Eight million voted, with Miss Lewis taking 60 per cent of the poll.

She gave four impressive performances, including a duet with Take That. Her 18-year- old rival sang with Westlife. Judges Simon Cowell, Louis Walsh and Sharon Osbourne had said it would be a 'travesty' if she did not win.

Speaking afterwards, Miss Lewis said: 'It's unbelievable. I feel like my dream has come true, the dream I've been dreaming since a little girl has come true'.

Of her rival, she said: 'Ray was amazing and I was honoured to be sharing a stage with him because he was fantastic.

'The only time I'd thought I'd won was when they told me I'd won.' Despite coming second, all may not be lost for Ray, who grew up in Knowsley, Merseyside, and starred in the soap Brookside. Cowell, who was mentoring both singers, hinted that he too would receive a record deal when he said he was planning to have a 'chat' with the teenager.

Miss Lewis grew up in Stoke Newington, North London, the only daughter of Joe, a youth offending officer for Islington council, and Marie, a 42-year-old social worker.

As a youngster she spent hours listening to her father's record collection and set her heart on being a singer, writing her first song at 12.

Her parents scrimped and saved to send her to the [pounds sterling]2,500a-term Sylvia Young Theatre School and also built a recording studio at home.

Although her first single is already on sale, Cowell said he would not be rushing Miss Lewis back into the recording studio.

'Leona has an opportunity, I think, to become a major, major worldwide star,' he said. 'We're not going to make an album quickly. We're going to make the best possible album.

'It's obviously in Leona's interests to make an album she's comfortable with and try and make everyone who voted for her proud that we've found a British girl who's up there with the Marias and Whitneys'.
